1. Who we are

ManikPola.com ("ManikPola", "we", "us") is a gemstone marketplace and brokerage operated by Sena Manik from Sri Lanka. By using this website you accept these terms.

2. What ManikPola is

ManikPola is a brokered marketplace. Sellers list gemstones; buyers register interest; we broker the transaction between them. We are not the owner of the gemstones listed unless a listing expressly says so. We act as intermediary, negotiating and facilitating on behalf of both parties.

3. Accounts

You must give accurate information when registering and keep your password secure. You are responsible for activity under your account. We may suspend or close an account that breaches these terms, misrepresents a gemstone, or behaves abusively toward other users or staff.

4. Seller obligations

• You must legally own the gemstone or be expressly authorised to sell it.
• All specifications — weight, treatment, origin, certification — must be accurate to the best of your knowledge, and anything uncertain must be declared as uncertain.
• Photographs must be of the actual stone, without manipulation of colour or clarity.
• You must not list stones acquired unlawfully or in breach of Sri Lankan mining, export or gem trade regulations.
• Once a price is agreed through us, you must honour it.

5. Buyer obligations

• Enquiries and offers must be made in good faith and with the genuine intention and ability to buy.
• You are responsible for import duties, taxes and any licences required in your own country.
• You must not attempt to circumvent ManikPola to deal directly with a seller introduced through this site.

6. Listing review

We review listings before publication and may reject, edit or remove any listing at our discretion. Review is a consistency check, not a laboratory examination, and publication is not a warranty of a stone's characteristics. Where you require certainty, request independent laboratory testing before payment.

7. Commission and fees

Listing and enquiring are free. A brokerage commission — currently 5% of the agreed price unless otherwise agreed in writing — is payable by the seller on completion of a transaction. Laboratory fees, shipping, insurance and bank charges are quoted separately and agreed in advance with the party responsible for them.

8. Circumvention

Where ManikPola introduces a buyer and a seller, the commission remains payable on any transaction between them concerning the introduced gemstone, whether or not it is completed through this website, for twelve months following the introduction.

9. Payment, inspection and delivery

Payment is secured by the broker before a stone is dispatched and released to the seller once the buyer has received and accepted the stone. Where a buyer requests independent testing, the outcome is shared with both parties before payment is released. Shipping is insured and tracked; risk passes in accordance with the terms agreed for that specific transaction.

10. Limitation of liability

To the fullest extent permitted by law, ManikPola is not liable for indirect or consequential loss, for loss of profit, or for the accuracy of information supplied by a seller. Our total liability in connection with any transaction is limited to the commission we received on it.

11. Content and intellectual property

You retain ownership of photographs and text you upload, and grant ManikPola a non-exclusive licence to display and promote them in connection with the listing and the marketing of the marketplace. The site design, code and editorial content remain ManikPola's property.

12. Governing law

These terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have exclusive jurisdiction over any dispute arising from them.

13. Changes

We may update these terms. Material changes will be announced on the website. Continued use after a change constitutes acceptance.
