Welcome to Manikpola, Sri Lanka's premier online marketplace for gem trading. These Terms & Conditions ("Terms") govern your access to and use of our website and services. By accessing or using Manikpola, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

These Terms are designed to ensure a safe, fair, and compliant environment for gem trading in accordance with Sri Lankan laws and regulations.

1. Website Usage

Manikpola provides a platform for buying, selling, and trading gems in Sri Lanka. Users must comply with all applicable laws, including the National Gem and Jewellery Authority Act No. 50 of 1993, Consumer Protection Act No. 1 of 1979, and other relevant regulations.

You agree to use the website only for lawful purposes related to gem trading. Prohibited activities include, but are not limited to:

• Listing or trading counterfeit, synthetic, or illegally sourced gems
• Violating export/import regulations for gems
• Using the platform for money laundering or other illegal financial activities
• Posting misleading or fraudulent information about gem quality, origin, or value
• Harassing other users or engaging in discriminatory behavior

We reserve the right to monitor, suspend, or terminate accounts that violate these usage guidelines.

2. User Responsibilities

As a user of Manikpola, you are responsible for:

• Providing accurate and up-to-date information in your profile and listings
• Verifying the authenticity and quality of gems before purchase or sale
• Maintaining the confidentiality of your account credentials
• Complying with all Sri Lankan gem trading regulations and obtaining necessary licenses
• Conducting transactions in good faith and resolving disputes amicably
• Not engaging in fraudulent activities, including but not limited to bid manipulation or false advertising
• Respecting intellectual property rights of others

Users must be at least 18 years old and have the legal capacity to enter into contracts. Sellers must ensure they have the right to sell the listed gems.

3. Payment and Fees

Manikpola accepts payments through approved methods, including bank transfers, credit cards, and digital wallets compliant with Sri Lankan financial regulations.

Transaction fees may apply for certain services, such as premium listings or escrow services. All fees will be clearly disclosed before transaction completion.

For gem purchases, buyers are responsible for payment upon agreement. Sellers must deliver authentic gems as described. Refunds may be processed in cases of proven fraud or misrepresentation, subject to our dispute resolution process.

All payments are processed in Sri Lankan Rupees (LKR) unless otherwise agreed. Users are responsible for any currency conversion fees or taxes applicable under Sri Lankan law.

4. Intellectual Property

The Manikpola website, logo, content, and software are protected by copyright, trademark, and other intellectual property laws of Sri Lanka, including the Intellectual Property Act No. 36 of 2003.

By posting content on Manikpola, including gem descriptions, images, and reviews, you grant us a non-exclusive, royalty-free license to use, display, and distribute such content in connection with our services.

You must not infringe on third-party intellectual property rights. This includes not listing gems that violate trademark or design rights.

We respect the intellectual property of gem designs and encourage users to report any infringements.

5. Dispute Resolution

In case of disputes between users, we encourage amicable resolution through our platform's messaging system or mediation services.

If mediation fails, disputes will be resolved through arbitration in Colombo, Sri Lanka, under the Arbitration Act No. 11 of 1995. The arbitrator's decision will be final and binding.

For disputes involving Manikpola, the courts of Sri Lanka shall have exclusive jurisdiction.

Users are encouraged to document all transactions and communications for dispute resolution purposes.

6. Amendments

Manikpola reserves the right to amend these Terms & Conditions at any time. Changes will be effective immediately upon posting on the website.

We will notify users of significant changes via email or prominent notices on the platform. Continued use of the website after amendments constitutes acceptance of the new terms.

Users should review these Terms periodically to stay informed of any updates.

7. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.

Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
